Despite an examination that revealed no injuries to any other part of her body, testing which revealed that Mrs. Jimenez was hyperglycemic and diabetic, and repeated statements that she had simply fallen in the bathroom, Defendants Trowers, Cohen, Merritt and Cyracom Agent (“Hospital defendants”) conspired together and created false records for Mrs. Jimenez, stating that she reported she had been physically abused by her husband, plaintiff Patricio Jimenez. The Hospital defendants supplied the false report to Defendant Detective James Quilty, who took steps to arrest Mr. Jimenez for domestic abuse, including going to his home and threatening to report him to immigration officials if he did not turn himself in. On January 30, 2013, Mr. Jimenez appeared at the police precinct where he was placed under arrest, arraigned on false charges, and ordered held on an immigration detainer as a result of an alert sent by Defendant Quilty, which falsely set forth that Mr. Jimenez had committed crimes for which he could be detained.
