Detective William Pepey arrested Carlton and searched his car without probable cause (nothing was found) and conducted an unreliable show-up procedure. There was also exculpatory evidence that wasn't disclosed to the jury regarding the identifying witness, Paul Anderson, first giving Detective John Loguercio a detailed description of 4 unidentified perpetrators, none of which resembled Carlton whom Mr. Anderson knew. Detective Pepey also orchestrated a second identification with a non-verbal shooting victim Jomo Kenyatta with an ID procedure that was not aligned with NYPD protocol. Although there was no physical or biological evidence or a confession the Queens County prosecutors  continued their prosecution of Carlton. The Queens County prosecutors failed to investigate Carlton's alibi and concealed exculpatory evidence that would have undermined the identification evidence and false statement attributed to Carlton. The Queens County prosecutors precluded any judicial review of the pre-trial statements and indetifications manufactured by Detective Pepey. In addition, they concealed the descriptions given to Detective John Loguercio by Paul Anderson. The trial prosecutor, Catherine Lomuscio, knowingly made materially false and misleading statements to the Court and the jury blustering the testimony of Anderson and Kenyatta and suborned perjury from both the civilian and police witnesses. Although ADA Lomuscio knew that Carlton had no prior record, during the trial she made allegation that he was a drug dealer and was intimidating witnesses. She further stated that Carlton had no \"real\" alibi and that the witnesses had no reason lie, all while either knowingly or having reason to know the witnesses she was using in her prosecution of Carlton had criminal histories relating to the violence and the drug trade.  ADA Lomuscio also led the jury to believe the witness, Anderson, had always stayed consistent with his statement to police regarding Carlton and took steps to suppressed his first identifications made to Detective Loguercio. Additionally, ADA Lomuscio permitted Detective Pepey to attribute an unnoticed, uncorroborated and false statement to Carlton in front of the jury and referenced it repeatedly during examinations and argument. Carlton spent over thirty-one (31) years incarcerated trying to prove his innocence and in 2021 his conviction was vacated when the Queens DA's Office joined a motion to vacate his conviction and dismiss the underlying indictment based on evidence compiled by the Conviction Integrity Unit (CIU).","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.488119/gov.uscourts.nyed.488119.7.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/65688076/roman-v-the-city-of-new-york/"}],"id":"J9UC","url":"https://www.50-a.org/officer/J9UC"}
