When Plaintiff arrived at Forest Avenue he saw the street was closed due to the St. Patrick's Day parade. As a result, Plaintiff attempted to turn into a parking lot. POs Sirintini and Espada approached on foot and directed Plaintiff to pull over into the parking lot. PO Matteo arrived on scene shortly thereafter. POs asked Plaintiff to provide his license and registration, and to step out of the car. Plaintiff complied. When Plaintiff exited the car PO Espada ordered him to turn around then placed handcuffs on Plaintiff, arresting him in front of his wife, daughter, and grandson knowing there was no justification to do so. Plaintiff begged for a breathalyzer test but POs refused to conduct any sobriety tests prior to taking Plaintiff to the 120th Precinct. \n\nAt the precinct a camera was set up to record Plaintiff during an interview and sobriety test. PO John Doe 1 told Plaintiff \"you know why you're here\" but after testing and interviewing Plaintiff PO John Doe 1 stated \"There's nothing wrong with this guy, who arrested him? They're trying to make me make the decision.\" After some time in custody, PO Espada told Plaintiff \"I have to give you a ticket.\" Plaintiff asked for what and PO Espada responded \"It won't give you any points but you have to pay $40.\" The ticket alleged Plaintiff's front plate was not displayed, which was false because the license plate on Plaintiff's vehicle was properly attached and clearly displayed. PO Espada willfully fabricated this charge to initiate a malicious prosecution against Plaintiff.
