Plaintiff was lawfully present at the aforesaid location when Defendants, approached assaulted, and battered Plaintiff, without any legal basis to do so as Plaintiff had exhibited no indicia of criminality and had not been observed violating any laws. Defendants punched and kicked Plaintiff and further slammed Plaintiff to the ground in an excessive and illegal fashion.\nDefendants violently contorted Plaintiffs arms and wrists behind his back to which they affixed handcuffs in an excessively tight fashion. Plaintiff repeatedly requested that Defendants loosen the handcuffs, because they were causing him substantial pain and discomfort due to their excessive tightness. Defendants ignored all of Plaintiff’s pleas to loosen the handcuffs. Defendants removed Plaintiff to St. Barnabas Hospital in Bronx, New York where Plaintiff was handcuffed and shackled to a gurney. Defendants further assaulted, battered, and struck Plaintiff inn an excessive and illegal manner while Plaintiff was immobile and shackled to the gurnery. Defendants transported Plaintiff against his will to the 42nd NYPD Precinct, where Defendants fingerprinted, photographed, searched and confined Plaintiff to a cell. At the Precinct, Defendants subjected Plaintiff to a humiliating strip search in which they forced Plaintiff to completely disrobe, and then squat down while nude to expose his anus and cough. Despite this intrusive, dehumanizing and ultimately unconstitutional search, no contraband was recovered. At no point prior to the above stated strip searches and cavity inspections did Defendants have any individualized suspicion that Plaintiff had secreted contraband into a body cavity or orifice. Plaintiff was eventually transported to Central Booking where he remained in a disgusting cell until his arraignment. Defendant Walcott signed or caused to be signed a criminal complaint against Plaintiff, in which they knowingly affirmed the truth of the fabricated allegations against Plaintiff, namely that Plaintiff was criminally in possession of narcotics or other drug-related crimes. Following Plaintiff’s arraignment, Plaintiff was remanded to various facilities on Rikers Island where Plaintiff was subjected to searches, strip searches with cavity inspections, gratuitous assaults and batteries, countless Civil Rights violations, and all the attendant indignities attributable to wrongful incarceration over the course of several months.
