James Landers is the legal tenant of the subject premises. On March 22, 2014, at approximately 11:30 pm., James Landers vacated the premises for the purposes of going to the corner deli. On March 22, 2014, at approximately 11:40 pm, James Landers returned to the subject premises and observed Defendant NYPD Officers Michael Temperino, Wilson Caro and Samantha Struman listening at the front doorway of the subject premises. As James Landers attempted to enter the subject premises he was stopped by Defendant NYPD Officers Michael Temperino, Wilson Caro and Samantha Struman and asked to provide identification. As James Landers was removing his identification the defendant officers forcefully took the key to subject premises from James Landers' person. The defendant officers than proceeded to enter into the subject premises without James Landers' consent.  Upon entering the premises, the defendant officers placed the plaintiffs under arrest and performed a search of each of the named plaintiffs. The searches performed involved strip-searching and checking their body cavities. During each of the searches, each of the individual plaintiffs were instructed to lie on the floor and were then kicked by Defendant Temperino and Caro. All defendants then searched the subject premises, where no contraband, weapons or illegal substances were found. No contraband, weapon or illegal substances were found on any of the plaintiffs' persons either. James Lander repeated to the defendant officers that the plaintiffs had permission to be in his house. After the defendants placed the plaintiffs under arrest and relocated them to the 70th Precinct and placed them in a holding cell, a strip-search was done of all plaintiffs. Despite the plaintiffs repeated requests, the defendants would not advise the plaintiffs of their arrest charges. Then the plaintiffs were then “chain-ganged” with hand and leg cuffs in preparation for their transport to Central Booking. Upon exiting the 70th Precinct station house, and as direct result of their being “chain-ganged” together, the Plaintiffs tripped and fell down the stairs outside of the 70th Precinct station house. Plaintiffs were then transported from the 70th Precinct to central booking. The defendant officers then wrote arrest reports alleging each plaintiff were in violation of Penal Law § 260.24 (Endangering Incompetent in the Second Degree) and Penal Law § 140.10 (Criminal Trespass in the Third Degree).
