Plaintiff stopped and waited to let the police car pass, but it did not, and continued to remain behind the plaintiff as he resumed driving slowly towards the side of the road. Plaintiff gestured to the police that it was safe for them to pass, at which point the police car pulled in front of plaintiff's vehicle and accused plaintiff of failing to yield to a police car, which plaintiff denied. One of the officers struck the plaintiff and knocked a phone out of his hand, and subsequently tried to pull plaintiff out of his car but failed. Officer Salasmartinez then Tased the plaintiff, who was then taken out of his car, forced to kneel in the street, handcuffed, and arrested without probable cause.
