Plaintiff followed them to 72-11 35th Ave, Jackson Heights, Queens, NY. Plaintiff took pictures of the construction site and HCC workers using his compressor and other equipment. Plaintiff called 911 to recover his misappropriated equipment. Two NYPD officers arrived and spoke with Plaintiff. Plaintiff explained the equipment belonged to him and he wanted it returned. Lomonaco arrived. Zizzo spoke with Lomonaco and on the phone with attorney Golden. Plaintiff sat on the hitch of the air compressor. Cruz approached Plaintiff, said \"stop resisting arrest\", punched, kicked, and threw him to the ground. While Plaintiff was on the ground, Zizzo and Cruz kicked and punched him. When Plaintiff was handcuffed on the ground, Zizzo sat on Plaintiff causing him to have trouble breathing. While still on the ground, Plaintiff asked officers to retrieve his expensive eye glasses. Zizzo intentionally stepped on and broke them before he collected them. Plaintiff was brought to a police car and taken to the 115th Precinct. At the precinct, Plaintiff requested medical attention. Plaintiff was taken to Elmhurst Hospital for treatment. Later that day, Plaintiff was taken to Central Booking, arraigned, and was charged with resisting arrest and criminal trespass. Zizzo signed the Criminal Complaint falsely charging Plaintiff. Plaintiff was released on his own recognizance. Plaintiff was forced to appear multiples times in Queens Criminal Court over two years. On July 31, 2013, Zizzo testified falsely at a pretrial hearing. Plaintiff was forced to stand trial, lasting two weeks. Zizzo and Cruz both testified falsely at the trial. PO Daniel Cruz and John Zizzo passed through the gated area of the residence and stood before them and began harassing them and demanding to know why they were there and asked for ID. After plaintiff stated he did not have identification and advised that he lived at the location, the officers grabbed Plaintiff, punched him in the face with a closed fist, and then repeatedly sprayed him in the face with pepper spray. Plaintiff was arrested, handcuffed and transported to the 115th precinct in a patrol car. PO Brian Marrin as supervising officer evaluated the arrest paperwork and charged Plaintiff of criminal trespass inside his own residence. \nPlaintiff was arraigned in Queens Criminal Court on October 4, 2012. Plaintiff entered a plea of not guilty, was released on his own recognizance, and the case was adjourned. At the time of release Plaintiff had been in custody for approximately 28 hours.
