Without a warrant or legal basis, the officers seized, detained, and handcuffed Plaintiff. Officers violently grabbed Plaintiff and struck his head against a wall. The force lacked legal justification and it was not reasonable for the officers to believe such force was necessary. Plaintiff was searched at the time of his arrest. No contraband of any sort was recovered from or possessed by Plaintiff. Nevertheless, he was taken to the precinct where he was kept in custody.  \n\nAt the precinct, officers completed arrest paperwork which, upon information and belief, alleged that officer Collins had seen Plaintiff in possession of an illegal pistol on the roof of a building, and that the pistol had been recovered in the area where Plaintiff had been arrested. Although the officers knew the allegations were false, they forwarded them to the DA or the Criminal Court in order to justify the arrest and to commence and/or continue Plaintiff’s criminal prosecution. At his arraignment, Plaintiff was charged with criminal possession of a weapon and criminal trespass. Plaintiff was indicted based on the false testimony of at least some of the officers. At a pre-trial suppression hearing on or about February 20, 2008, officer Collins testified for the prosecution and continued to maintain the same fabricated story he and the officers had originally concocted, and the suppression motion was later denied. At the trial in or about May of 2008, officers Collins and Teta again made false claims and on June 4, 2008, Plaintiff was convicted on all counts. Plaintiff was sentenced on November 12, 2008, to a determinate period of incarceration of twelve years, with five years' post-release supervision. On April 26, 2011, an appeals court vacated the conviction and dismissed the weapons charges, and remanded the case for the purpose of resolving the one trespass count. The plaintiffs were then subject to an illegal search with the defendants harassing and threatening harm to them. Nothing was recovered from the searches, but the defendants nonetheless arrested the plaintiffs and transported them to the 100th Precinct. The defendants falsely stated to prosecutors that the plaintiffs were in possession of a weapon.
