Sean Feliciano, P.O. Matthew Demaio, Sgt. Robert Dandrea, P.O. Alexis M. Yanez, and P.O. John/Jane Doe(s) knocked on the Plaintiffs’ door and unlawfully entered the Plaintiffs’ home without consent or a warrant, despite Plaintiff 1 telling the Defendant officers that they would need a warrant. The Plaintiffs were awoken, handcuffed and removed from their beds and placed in the living room. The Defendant officers pushed Plaintiff 2 face first into a couch while his arm was violently pulled behind his back. The Defendant officers threw both Plaintiff 3 and 4 to the ground and struck multiple times about their face and body. The Defendant officers placed Plaintiff 5 in excessively tight handcuffs and ignored his pleas to have his handcuffs loosened. The remaining defendant officers ransacked the Plaintiffs’ home. The Defendant officers claimed to have heard a gunshot provoking their entrance but did not have probable cause to enter the Plaintiff’s home. The Plaintiffs were each unlawfully arrested without probable cause and taken to the 75th precinct. Plaintiff 2 and Plaintiff 3 were neither wearing shoes or a shirt when they were taken to the police vehicle. The Plaintiffs each remained at the precinct for over two days. Plaintiff 2 and Plaintiff 3 were minors and were not placed in the cells but handcuffed to chairs for the two days they were at the precinct. Plaintiff 2 and Plaintiff 3 were later taken to a juvenile detentions center, where they were released approximately five days after their arrest. Plaintiff 2 and 3 were not allowed to return home upon release and placed with their aunt. The other Plaintiffs were taken to Brooklyn Central Booking, where they were released after over three days in custody.
