Defendant Jiminez greeted Plaintiff. Plaintiff responded by asking, “Are you waiting for a parking spot?” Defendant Jiminez told Plaintiff that she was prostituting. During this time, Defendant Officers were parked in two vehicles—one marked NYPD vehicle parked about fifty feet away and one unmarked vehicle parked a few blocks away. Defendant Officers suddenly approached Plaintiff from behind. Defendant Romero handcuffed Plaintiff. Plaintiff was later informed that he had been arrested for soliciting prostitution. Plaintiff was put in a NYPD van with five individuals, who were also arrested in the same “sting” operation. Plaintiff was transported to the NYPD 46th Precinct. Plaintiff was arraigned on the basis of an accusatory instrument signed by Defendant Grant that falsely charged Plaintiff. Plaintiff was finally released from custody on August 21, 2011 after being detained for about 48 hours. Over three years, Plaintiff was required to appear in court about twenty-four times to defend the charges against him. Defendants used their hands to search inside of Plaintiff’s pants and groped and fondled her private parts. The male officers also searched her and found nothing. The two male officers then called a female officer to search Plaintiff again. Defendants still did not find any illegal items on Plaintiff. Plaintiff was then taken to the 46th precinct, where Defendants were trying to strip search her. Plaintiff protested this third search. However, a Captain came over and told her to comply with it. Plaintiff was strip-searched, and Defendants did not find any illegal items on her person. Plaintiff was detained at the precinct, and her arrest processed. Plaintiff was then taken to court for an appearance before a judge. Plaintiff spent approximately 72 hours in custody until she was let go from central booking after being released ROR. After three individuals (not parties to this complaint) arrived to inquire about puppies for sale, they were stopped on their way out of the garden by Officer CINTRON and another unidentified officer. CINTRON searched them and found a crack pipe on one of the individuals. CINTRON then accosted SUAREZ whom he knew because CINTRON had been accused of falsely arresting and assaulting Suarez's brother two years prior. At the time of this incident, the charges against CINTRON were still pending in Bronx Supreme Court. CINTRON then searched Suarez without cause and found $190 and arrested Suarez. CINTRON then searched Ocasio without cause and found $580 and arrested Ocasio as well. While other officers, including Defendants JIMENEZ and BAAITH, ransacked the community garden in search of contraband that was never found, Suarez and Ocasio were taken to the 46th precinct where they were strip searched in a bathroom. This search included \"feeling around [their] anuses.\" No contraband was found. Suarez, who suffers from an anxiety disorder, and Ocasio, who takes methadone, were both denied their medication and suffered severe anxiety and withdrawal symptoms respectively as a result. Suarez and Ocasio were taken to Central Booking in the early hours of June 9 and eventually arraigned at midnight on June 10 (the complaint erroneously indicates midnight June 9) and charged with sale and possession of a controlled substance. The charges were based at least in part on the alleged observations of JIMENEZ and BAAITH who were not present when the alleged sale took place but only arrived later after CINTRON called for backup. Ocasio was released on his own recognizance, but Suarez was sent to Riker's Island and not released until June 11. The individual who yelled at the plaintiff, who was a police officer, screamed again, and thereafter defendant police officers Ellines Jimenez and Angel Gonzalez, in plains clothes, jumped out of their car and ran full speed at plaintiff who was standing on the sidewalk. Defendants did not identify themselves as police officers. \n\nThe defendants grabbed plaintiff's arms and interlocked them with their arms, and forcibly slammed plaintiff onto the trunk of her car causing plaintiff to suffer serious physical injuries, including but not limited to both of her shoulders. NYPD Officers John Does #1-4, who were also at the scene, failed to intervene to prevent the unlawful detention, assault, and battery of plaintiff. Plaintiff was handcuffed and transported to the 46th precinct against her will, where she was refused medical attention.
