Consequently, the Plaintiff’s ankle was fractured, resulting in multiple surgeries, swelling and multiple abrasions and lacerations, at least one of which required stitches. The Plaintiff was taken to Woodhull Hospital to get evaluated as an emotionally disturbed person, where he was handcuffed to a hospital gurney and held for several hours for treatment before being transported to a nearby precinct. At the precinct, he was searched and confined in a holding cell for several hours. The Defendant officers provided false and misleading reports to the DAs office and initiated a malicious prosecution against the Plaintiff, where he was falsely charged with Assault, Attempted Assault, Harassment, Burglary, Criminal Mischief, Obstructing Governmental Administration and Criminal Trespass. On April 26, 2020, a gold ring was stolen from Mr. Fernandez's apartment. When Officers Galindo-Sanchez and Martino arrived, they began to intimidate and taunt Mr. Fernandez. On April 30, 2020, another burglary occurred at Mr. Fernandez's apartment, where Mr. Fernandez reported the incident to his doorman. Shortly after 6 NYPD officers and 2 paramedics arrived, including Officers Galindo-Sanchez and Martino. Mr. Fernandez began taking video of the incident on his phone and he was immediately placed in handcuffs. He was taken to Woodhull Medical Center where staff refused to give him food, drink or blankets. The next morning, hospital staff negligently inserted a needle in his arm in order to gather blood, causing him to faint. Mr. Fernandez was frequently harassed and taunted by hospital staff during his stay, including allowing another patient to assault Mr. Fernandez on multiple occasions. The following day, Mr. Hernandez was released without being formally diagnosed.
