POs slowly walked around the area, picked up what appeared to be a discarded cigarette butt, walked to Plaintiff, and stated \"I am putting this on you.\" \n\nPlaintiff was unlawfully handcuffed, arrested, and transported to the 47th Precinct where he was criminally processed without recovering any illegal items. POs then unlawfully interrogated Plaintiff regarding the individual they mistook him for. Plaintiff was unable to answer their questions. Thereafter Plaintiff was fingerprinted, at which point POs realized Plaintiff was not the individual they had believe him to be. To avoid discipline, POs falsely charged Plaintiff with Criminal Possession of Marijuana.
