Jacques was lawfully at the location observing a peaceful protest when unlawfully stopped, questioned, frisked, and arrested Dovonou without a probable cause or justification. Dovonou was no where near the police barricade or police vehicles. When Dovonou saw the officers pushing the peaceful protesters to the ground and arresting them, he was asked to get off the street-which he complied. However, one of the officers grabbed Dovonou and tackled him to the ground and handcuffed him to his back. At no time did Dovonou resist the arrest. Dovonou's zip handcuff was extremely tight and was causing him pain, injury, and difficulty in breathing. Dovonou asked for medical treatment, but was denied. The officers had duty to intervene, but failed to do so. Dovonou suffered injury on his teeth, leg, hand and shoulders and physical, emotional, and psychological trauma as a consequence of officers' misconduct. He also suffered from loss of liberty, emotional distress, embarrassment, and humiliation. Plaintiff went back inside to get his food and walked home, stopping to speak with a friend on the way. Two cars pulled up with plainclothes men pointing weapons and threatening to shoot. They proceeded to search plaintiff and identified themselves as officers. They stated that he fit the description of a robber that had robbed someone nearby. An officer identified plaintiff and instructed the others to complete the arrest. Det. Shawn Wilkinson and Det. Steven Gansrow then forced plaintiff into the car and took him to the precinct. While there, plaintiff was told that he was there for possession and sale of marijuana and that given his parole status, he could be given the max sentence for his case. He was then told that he could go if he gave information. Plaintiff declined because he did not know the other person on which they wanted information. Plaintiff was charged and no evidence was ever offered as to whether narcotics were recovered from plaintiff.
