In the facility, Plaintiff was assaulted by some of his inmates, and correction officers did not intervene when they were present during the assault. As Plaintiff was exiting Central Booking Det. Tracy Travis and Sgt. Arnold Torres unlawfully approached, handcuffed, and arrested Plaintiff without legal justification. POs stated Plaintiff was being arrested for stealing a phone approximately 6 months prior, though they had no probable cause or legal justification to believe Plaintiff had participated in stealing a phone: Plaintiff did not match the description of the alleged perpetrator, no individual actually accused Plaintiff of committing this crime, and POs did not recover a stolen phone from Plaintiff. \n\nRegardless Plaintiff was unlawfully seized, handcuffed, and falsely arrested by POs and transported to Bronx Transit District 12 then the 48th Precinct. Plaintiff was forced to participate in a line up but was not picked because he had not committed the alleged crime. As a result, in order to cover up their unlawful arrest of Plaintiff, POs charged Plaintiff with Criminal Possession of Stolen Property, despite Plaintiff not being in possession of any stolen property and despite that none was recovered from Plaintiff. Plaintiff was held for several hours while POs attempted to initiate a false prosecution against him. Plaintiff was released after being unlawfully detained for approximately 12 hours, at which time he was informed the District Attorney declined to prosecute the false charges.
