Some of the POs had a history of misconduct prior to this incident. The occupants, including Plaintiff, exited the vehicle as ordered. Plaintiff had been recording since the initial stop and continued recording after exiting the vehicle. POs asked Plaintiff for identification and when Plaintiff asked why POs falsely arrested Plaintiff. Specifically, POs grabbed Plaintiff, slammed him against a vehicle, and placed excessively-tight handcuffs on Plaintiff. Plaintiff was taken to the 44th Precinct and wrongfully searched. POs kept Plaintiff detained for several hours before his release and provided false police reports to justify his detention. When the elevator stopped on the third floor, Plaintiff observed a group of people fighting just outside the doors, and some of this group ran onto the elevator before it continued its descent. When the elevator doors opened on the ground floor of the courthouse, several Defendant Officers were waiting and began to grab several people from the elevator, including Plaintiff. Plaintiff and bystanders informed Defendant Officers that Plaintiff was not involved in the altercation, but nevertheless Defendant Officers began to arrest Plaintiff, restraining him with unreasonably tight metal handcuffs. While Plaintiff was later in custody, Defendant Officers forwarded the Bronx County District Attorney’s Office false, misleading, and/or incomplete information that Plaintiff committed a crime.
