When defendant officers stopped and frisked plaintiff and obtained no contraband, instead of releasing plaintiff, plaintiff was cuffed and detained to search for evidence of a crime.  \n\nPlaintiff was then falsely charged by defendant officer Weck of Disorderly Conduct, for running towards plaintiff in a violent manner when body camera footage shows that plaintiff stood completely still with his hands in the air as officers approached him. \n\nThe District Attorney's office declined to prosecute the bogus charge. \n\nOn June 5, 2021, defendant officers of the 40th Precinct including but not limited to defendant officers Hijazi and Juciano pulled over Plaintiff, asked him to step out of his vehicle, and arrested him. Defendant Sgt. Santos responded to the scene and did nothing to prevent the unlawful arrest or detention of Plaintiff. The officers did not look up Plaintiff’s driving record for at least two hours after the\narrest, at which time they used the information to charge Plaintiff with a traffic infraction without conducting any testing on the substance found in the vehicle to\nconfirm its contents, and maliciously charged Plaintiff without probable cause that the substance was, in fact, unlawful. Defendants held Plaintiff for over 24 hours before sending him to arraignment for the improper purpose of gathering evidence to cover up the unlawful stop.\nAll charges arising from this unlawful stop were dismissed in their entirety on the\nnearly two months later, on July 29, 2023. \n\nOn November 11, 2022, Does 1 and 2, both described as\nHispanic males, came to Plaintiff’s Bronx home, entered his bedroom while\nhe was asleep, shined their flashlights in his eyes, and claimed to have a warrant for his arrest. No such warrant ever existed.  At some point, Plaintiff learned that he was suspected of participating in a robbery. But after some time, Plaintiff was told that the case against him was “dismissed.” The Doe Defendants held Plaintiff for an additional 1–2 hours, again without probable cause, claiming that that there was a second warrant that needed to be “cleared” before Plaintiff could leave. Again, no such warrant ever existed. When the Doe Officers found nothing, they let Plaintiff go without any ticket, summons, or other paperwork, and Plaintiff never heard anything of the supposed warrants or potential charges again.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=_PLUS_Quw2bFJy4Pbh7AcAnhU7w==","type":"complaint"}]},{"name":"Santana, Luis vs City of Ny, et al.","start_date":"2023-06-22","payout_amount":0,"disposition":"","docket":"809523/2023E","court":"Supreme Court - Bronx","summary":"On February 2, 2021, Plaintiff LUIS SANTANA was a passenger in vehicle when that was stopped by an unmarked police vehicle containing four NYPD officers. After confirming the license was valid one of the NYPD officers asked\nSANTANA and the other occupants to exit the vehicle because they needed to search it, alleging there was a smell of \"weed\", despite no one smoking inside the vehicle. All of the occupants complied with the directive and exited the vehicle. SANTANA and the other occupants were handcuffed while they were searched on the street at the rear of the vehicle. Simultaneously other NYPD officers arrived on the scene and started to search the BMW that SANTANA and the other occupants just exited.\n\nAfter 15-20 minutes had elapsed and no contraband was found, the NYPD officers removed the handcuffs and allowed plaintiff SANTANA and the other occupants to get back in the vehicle. Just as they were about to be allowed to leave, one of the officers asked the owner of the vehicle to open the trunk. Upon opening the trunk, defendant officers LUCIANO and CALLE claimed to observe marijuana and a loaded 9mm handgun. Despite SANTANA being a passenger in the vehicle, he was removed from the vehicle, re-handcuffed and arrested along with the other occupants of the vehicle. \n\nSANTANA sat in central booking for roughly 12 hours and finally was arraigned before a judge at approximately 9:30pm. SANTANA was charged with two counts of felony possession of a weapon and one misdemeanor possession of marijuana. SANTANA professed his innocence throughout the pendency of the criminal case, appearing approximately fifteen to twenty times before the case was finally dismissed on December 13, 2022.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=8BvP5UP0Vr2hKTAGOxzteQ==","type":"complaint"}]}],"discipline":[{"disposition_date":"2022-08-16","case_no":"2020-21977","penalty":"Training","recommendation":"Training","allegations":[{"desc":"Improper search of an individual"}]}],"image":"https://www.50-a.org/images/officer/JRZV-ivan-luciano.jpg","payroll":{"salary":"119314","regular":"115608","overtime":"71189","other":"14961","total":"201759"},"id":"JRZV","url":"https://www.50-a.org/officer/JRZV"}
