Defendants entered the apartment with their guns drawn and told everyoen in the apartment to get onto the floor. Defendants broke through plaintiff's locked bedroom door and pointed their gun at plaintiff, threw him down in a violent manner, kicked him onthe  floor and unlawfully handcuffed him without probable cause. Defendants unlawfully searched and handcuffed Plaintiff. Defendants did not recover any illegal weapons or drugs from Plaintiff or his bedroom. Defendants falsely arrested and imprisoned Plaintiff without probable cause or legal justification. Defendants gave the New York County District Attorney's Office with a false and misleading description of the facts and evidence in their possession and Defendants intentionally neglected to tell the District Attorney's Office that Plaintiff was not a gang member and not someone they were investigating before executing the warrant. Defendants falsely arrested Plaintiff and transported him to the PSA 4 Precinct and detained Plaintiff in a holding cell for many hours. Then, Plaintiff was transported to New York County Central Booking where he was detained in several large holding cells with other prisoners. On February 20, 2015 Plaintiff suffered a seizure while detained at Central Booking because of he extreme emotional distress and anxiety he was suffering from. Plaintiff was taken in an ambulance to Lower Manhattan Hospital for treatment. After he was released, he was then taken back to Central Booking. Defendants initiated a criminal prosecution against Plaintiff on February 21, 2015. On February 21, 2015 at 12:40 am plaintiff was arraigned in New York County Criminal Court and charged with crimes he did not commit. At arraignment, Plaintiff couldn't post bail and was taken to the NY City Department of Correction custody and held in the Manhattan Detention Center until February 22, 2015 at 2:55 am when he was released after plaintiff posted bail. Plaintiff was required to appear in NY County Criminal Court to address the criminal charges filed against him and the charges were dismissed against him on December 21, 2015 and were sealed in their entirety. The NYPD officials ordered the occupants to freeze and drop to the floor—an instruction that the plaintiff obeyed.  While the plaintiff lie face down on the floor, the NYPD officers kicked him repeatedly, causing him pain.  At no time did the NYPD defendants have an objective, factual basis to believe that the plaintiff violated any laws.  The plaintiff showed the NYPD defendants his government-issued identification card establishing that he was not a resident of the apartment.  Nevertheless, the officers arrested the plaintiff, transported him to the PSA4 Precinct, subjected him to a search, fingerprinting, and photographing, and locked him in a cell containing rodents and insects.
