Officers were in plain clothes and did not announce themselves as police. Upon seeing strangers in his apartment with guns pointed at them, and unaware these were police, Plaintiff and his cousin panicked. The cousin exclaimed they were being robbed. To avoid being robbed, plaintiff jumped out of the second story window, severely injuring himself in the process. When officers identified themselves, Plaintiff’s cousin assisted wounded Plaintiff off the ground and back inside his apartment. In the apartment, defendants threw Plaintiff to the ground, despite his visibly bleeding face and mouth. Defendants arrested Plaintiff, restraining him with \ntight metal handcuffs and subjected him to an unlawful pat-down search. Plaintiff’s primary language is Spanish; he understands and speaks little-to no English. Handcuffed and confused, Plaintiff pleaded with the defendants for immediate medical attention as best he could. Plaintiff was dripping blood from his mouth, missing teeth, and in pain. Defendants realized they entered the wrong apartment, and Plaintiff and his cousin were released from their custody without charges. An officer with some Spanish-speaking ability explained to Plaintiff they entered the wrong apartment and apologized. Plaintiff sought medical care at Metropolitan Hospital. Plaintiff lost several teeth and had his jaw wired shut for a month. Plaintiff sustained serious injuries to his face, mouth, and left knee.
