After dismounting his bike and before speaking to the acquaintance, Defendants--NYPD Police Officers Nicholas Contardo and NYPD Police Officers John/Jan Doe Numbers 1-10--immediately and unlawfully searched and handcuffed the Plaintiff without any probable cause. When Plaintiff asked the Defendants why he was being arrested, they stated \"You know what you did\" and nothing further. There was never any indication that the Plaintiff did any illegal acts or possessed any illegal items. Defendants then took the Plaintiff and his bicycle to the 5th Police Precinct in Chinatown, where he was searched, fingerprinted, photographed, and held for five hours before being taken to New York Central Bookings. \n\nAt Central Bookings, the Plaintiff was searched, fingerprinted, photographed, retinal scanned, and held in a holding cell with 15 people without masks for approximately 24 hours. Though Plaintiff was later released on his recognizance and given a court date, Plaintiff was later charged with one count of Making Graffiti and one count of Possession of Graffiti Instruments. On June 2nd, 2021, the Plaintiff's criminal charges were dismissed because the District Attorney was told by Defendant Officer Contardo that the Plaintiff never committed the crimes he was charged with.
