Plaintiff complied with the order to the back of the vehicle, and agreed to the test. Plaintiff completed the test two or three times. The breathalyzer results showed plaintiffs blood alcohol content was 0.00%. Defendants handcuffed, arrested and transported plaintiff to the highway patrol precinct. Defendants ordered Plaintiff to complete a walking and coordination test. Plaintiff passed the test. Defendants ordered Plaintiff to take another breathalyzer test at the precinct. Results of each test showed Plaintiff had a blood alcohol content of 0.00%. Plaintiff was transported to the 30th precinct. Defendants wrote in their reports Plaintiff refused to take any of the six breathalyzer tests. Plaintiff's drivers license was suspended. Plaintiff was transported to Manhattan Central Booking. After 27 hours, Plaintiff was arraigned. Plaintiff returned to court on four occasions.
