Defendant Carney attempted to search Plaintiff, then threw Plaintiff against boxes on the sidewalk.  Defendants Carney and Zhao aggressively and forcibly grabbed Plaintiff, threw him to the sidewalk, and began to viciously beat Plaintiff, without just cause or legal justification. Plaintiff did not use or threaten use of a weapon or force, but rather sought to protect himself by covering his head with his hands. Defendant Carney punched Plaintiff in the face. Defendant Zhao took no action to intervene. While Defendants Carney and Zhao were beating Plaintiff, two Defendant NYPD Officer Does arrived and similarly began to assault Plaintiff. Ultimately, no less than 15 additional Does arrived and surrounded Plaintiff as the assault continued.  Plaintiff suffered severe injuries and extreme severe pain and discomfort.  Defendants falsely claimed that Plaintiff assaulted Defendant Carney and resisted arrest.  Plaintiff was brought to the precinct for processing, then brought to central booking, and was arraigned the next day and released.  On December 24, 2021, Defendants charged Plaintiff with Assault in the Second Degree and Resisting Arrest.  Despite the lack of evidence substantiating the charges, the prosecution of Plaintiff was continued with malice. Such malicious prosecution caused Plaintiff to incur financial damages, and when information about the arrest and/or prosecution was intentionally and maliciously released to the public, Plaintiff's reputation was damaged and it caused Plaintiff shame and humiliation. Against the Plaintiff's will, the Defendants brought the Plaintiff to the precinct, where he was unlawfully fingerprinted, photographed, searched, and detained. Defendant McQuail signed a criminal complaint against the Plaintiff, claiming he had committed a robbery the night before.
