Plaintiff’s friend was inside his car while Plaintiff was next to the car on the sidewalk. An unmarked police car passed Plaintiff and his friend three times, staring at them each time they passed. After their third passing, the unmarked police car parked behind Plaintiff’s friend’s car. They approached them and instructed Plaintiff and his friend to go to the back of the vehicle. Without asking for his license and registration, one officer accused Plaintiff’s friend of not owning the vehicle and demanded he surrender the keys. The officer snatched the keys from Plaintiff’s friend’s hands and proceeded to punch him in the face. The officer kicked Plaintiff’s friend, threw him to the ground, pepper sprayed him, and continued kicking him until he was under the car. Plaintiff tried to tell the officers he didn’t do anything, but the second officer told him to shut up and punched him in the face and shoulder. Plaintiff fell to the ground and was handcuffed. Plaintiff was arrested and charged with criminal mischief. Plaintiff was incarcerated for approximately 24 hours. Plaintiff was ROR’ed at his arraignment on October 2, 2013.
