POs requested paperwork and Plaintiff provided, also asking why he was pulled over. PO Mangual told Plaintiff he was pulled over for speeding, then walked to the trunk of his police car, retrieved a tint meter, and returned to Plaintiff. Plaintiff's vehicle did not have tint on the windows. PO Mangual told Plaintiff to roll his car windows up, then further, than down and Plaintiff was confused regarding the contradictory instructions, stating \"I am trying to comply.\" PO Mangual responded by reaching into Plaintiff's car, pulling him out of his car, and wrestling Plaintiff with PO Kowalski until Plaintiff was handcuffed. PO \"FNU\" Jimenez arrived on scene during this time and all three POs attempted to place Plaintiff in the police car. \n\nPO Jimenez tackled Plaintiff using his left shoulder and body, kneed him in the groin, and tackled Plaintiff a second time causing Plaintiff's top half to be in the car and bottom half to be out. PO Jimenez then slammed the car door on Plaintiff's legs repeatedly and all three POs used batons on Plaintiff's legs. One of the POs walked to the other side of the police car and yanked Plaintiff fully into the car via his cuffed hands. One PO sprayed pepper spray into the back seat of the car and shut the door and one PO sprayed pepper spray from the front passenger door directly into Plaintiff's face, closed the rear partition, and shut the car door. POs forced Plaintiff to remain in the car for thirty minutes. Plaintiff was taken to the 42nd Precinct and had to be carried in. Plaintiff received medical attention then was taken to Central Booking, where he remained for approximately two days and was only provided Tylenol for his medical treatment. Plaintiff was maliciously charged with a variety of crimes and all charges were ultimately dismissed (some by acquittal).
