Plaintiff's friend owned a store at 315 Broadway, NY, NY. Plaintiff learned his friend was being arrested for selling counterfeit merchandise, and asked plaintiff if he would come to the store and lock it for him, as the friend was being arrested and could not lock up. Plaintiff's friend informed NYPD officers his friend was coming to the store to lock it. Plaintiff left work and traveled to his friend's store. At the store, plaintiff secured merchandise and closed the store. Defendants approached plaintiff and handcuffed him. Plaintiff advised defendants he was not the owner, explained the owner of the store was just arrested, and he was closing the store as a favor. Defendants arrested plaintiff. Plaintiff was transported to the 1st precinct, and placed in a holding cell. Plaintiff was transported to New York Central Booking and detained overnight in a holding cell. On March 15, 2012, plaintiff was arraigned in New York Criminal Court and was released on his own recognizance.
