On his way up, Plaintiff was approached by the two defendants who asked if he lived in the building. Plaintiff said he did not, was there visiting a friend, and provided identification. Plaintiff was pushed against a well, tightly handcuffed and unlawfully searched for contraband but Plaintiff had no contraband. Though not having observed Plaintiff committing any crimes, Plaintiff was taken in handcuffs to the 73rd Precinct and eventually Central Booking. There, individual defendants prepared false police reports accusing Plaintiff of Criminal Trespass in the 3rd and 4th Degrees and Resisting Arrest.  Defendant O’Leary made false statements to the Kings County DA’s Office, causing plaintiff to be prosecuted under Kings County Criminal Court on false charges. Plaintiff was arraigned in Kings County Criminal Court, and criminal charges were adjourned in contemplation of dismissal.
