Plaintiff was on the southeast sidewalk on Washington Square East between West 4th Street and Washington Place. Soon after Plaintiff began preaching, a crowd of Pride festivalgoers formed in front of Plaintiff and began heckling and throwing objects at Plaintiff. Upon seeing the crowd, a group of Doe NYPD officers approached, and instructed Plaintiff to \"shut it down.\" One officer explained that it would be easier for Plaintiff's group to leave rather than to disperse the crowd that had formed. Plaintiff explained he was exercising his right to free speech on the sidewalk and that he would not leave. While waiting to speak with the Sergeant, officers told Plaintiff to lower his banner. Plaintiff refused. The unnamed Sergeant and another officer, identified as Captain Turner, asked Plaintiff and his group to leave, and Plaintiff again refused.  Officers eventually put up a barricade to separate the crowd from Plaintiff's group. Officers then told Plaintiff that he and his group would be arrested if they did not leave. Officers did not intervene in the crowd's heckling or throwing objects, and did not disperse the crowd. An unnamed Captain again directed Plaintiff's group to leave, and escorted them away, along the sidewalk. Plaintiff refused to continue walking, and officers then arrested Plaintiff's group and transported them to jail, where they were detained for approximately 2.5 hours.
