The vehicle accident was in not part by Reyes's negligence, but was solely due to NYPD and Yung's negligence in, but not limited to, maintenance of the vehicle, driving the vehicle properly, awareness of the surrounding near the vehicle. This vehicle contact was not in any way justified.
