Officers immediately grabbed one of the Plaintiffs, banged his head against a wall, and then threw him to the floor. One of the officers thereafter placed one of his feet on the head of Plaintiff, applying excessive and unnecessary pressure to his head with an intent to injure him. That Plaintiff was subsequently thrown on a bed, where he, including his private parts, were searched in full view of other officers. Meanwhile, the other Plaintiff was grabbed off the chair where he was sitting and thrown on the floor, where he remained until officers searched and handcuffed him. The Plaintiffs were taken to the precinct and Central Booking, where they were held for several hours, before they were released without any explanation as to why they had been arrested in the first place. \n\nOfficers forwarded false allegations about the arrest to the DA’s Office. Upon information and belief, Plaintiffs were released only after the DA’s Office declined to prosecute Plaintiffs based upon the lack of probable cause that existed for the arrest or prosecution of Plaintiffs. While at the precinct, one of the Plaintiffs repeatedly requested medical treatment, which he was denied. The following officers are named in the complaint: P.O. Todd Hansen, Sgt. Damon Martin, P.O. Robert Mayer, Sgt. Robert Martinez, P.O. Radoslaw Terepka, P.O. Anthony Donaldson, Det. Albert Gut, P.O. Charges Steiger, Det. Michael O'Brien, Det. Robert Schierenbeck, Sgt.Frank Ferrara, Det. Jorge Salazar, Det. Gary Grisolia, Det. Jeffrey Loughery, and Det. Plaintiff Larvelle Bell was escorted at gun-point to a room where he was kicked to the ground. Larvelle witnessed officers destroying property in the apartment before he was unlawfully arrested and transported to the 73rd precinct. After approximately 24 hours in custody, he was released with no charges filed against him. Plaintiff Ivanta Bell-Simon was handcuffed in the apartment for approximately 2 hours, taken to the 73rd precinct, and detained in a cell for approximately 13 hours. As a result of being in custody, plaintiff missed the birth of his twin sons.
