An off-duty, plain-clothed unnamed NYPD officer grabbed Mr. Conrad and escorted him out of the Food Emporium where defendant unnamed NYPD officers and sergeants arrived at the scene. An officer tackled Mr. Conrad to the ground, fracturing his jaw and causing contusions and lacerations to Mr. Conrad's face. Mr. Conrad was restrained on the ground and attempted to lift himself up from the ground and release himself from the grip of the officer. Mr. Conrad was then shot nine times. The manner of death was deemed a \"homicide (shot by police).\" The autopsy indicated that the gunshots that caused Mr. Conrad's death were angled at a downward trajectory, indicating that Mr. Conrad was either on the ground or falling at the time he was shot. No alcohol or drugs were found in Mr. Conrad's system. Despite the fact that PO Peralta was well over 150 yards away, PO Peralta accused Plaintiff of damaging this supposed car. Plaintiff informed PO Peralta he was certainly mistaken. In response PO Peralta stated Plaintiff was disrespecting him and on that basis Plaintiff was going to be arrested. Plaintiff put down his briefcase and tied his dog to a nearby sign, which PO Peralta intentionally mistook for resisting arrest. Plaintiff explained there were others nearby who would take in the dog but PO Peralta ignored Plaintiff. By this point a crowd, among them Plaintiff's friends, neighbors, co-workers, and acquaintances, had gathered with video and other cameras. PO Peralta wrongfully told the onlookers to stop videotaping but they declined. PO Peralta's partner apologized to Plaintiff but stated he had to back PO Peralta up because he was his partner. Plaintiff was ultimately handcuffed in public on the side of a street for over one hour. PO Peralta falsely caused a summons to be issued that falsely accused Plaintiff of screaming and inciting a crowd, which was easily disproved by onlookers' videotaped evidence. The summons was dismissed on December 1, 2014.
