The NYPD vehicle was a marked police car, but the lights and sirens were not in operation. The occurrence and the resultant injuries sustained by Plaintiff were caused solely by and through the negligence, carelessness, recklessness and wanton disregard on the part of the defendants. Plaintiff, who was in no way negligent, was caused to sustain serious and severe personal injuries. \n\nHours after the accident, either late in the night on March 31, 2012 or early in the morning on April 1, 2012, Plaintiff was issued summons alleging that Plaintiff’s vehicle was unregistered for a period over sixty days, and that Plaintiff failed to yield to an emergency vehicle. Upon information and belief, the aforementioned summonses were drafted by PO Christopher Diaz pursuant to the orders of Jeffrey Tuechler. As a result of the summons, Plaintiff was subject to, inter alia, false arrest.
