As Plaintiff Lang gave the passerby a cigarette, Defendant Khan approached Plaintiff Yander and asked for identification. In response, Yander asked Khan why he needed to see ID. Khan replied that he did not need to give Yander a reason for the production of ID. Yander attempted to get his ID out of his wallet. Khan began to yell at Yander regarding his ID. Yander was suddenly and violently shoved against a wall by Khan and then thrown on the ground face first, causing multiple abrasions and lacerations to Yander's hands, shoulders and knees. Khan handcuffed Yander's hands tightly behind his back. Lang asked Khan and an officer why they were treating Yander in this matter. Khan told Lang he was going to be arrested also. Lang was handcuffed. Both Plaintiffs were searched and transported to the 61st precinct for several hours prior to being released with summonses issued to each Plaintiff by Kahn charging Plaintiffs with Disorderly Conduct.
