When Plaintiff attempted to re-enter the building and return to his bed, Defendant Shelter/DHS employee Tynishia Stewart, refused him entry, stated he was being transferred shelters, and called the police when Plaintiff attempted to peacefully return to his bed. Defendant Officers Jesus Montesino, Jenny Pacheco, Nikauri Terrerro, Victor Velez, and John and Jane Doe 2-7 arrived on the scene and approached Plaintiff. After Plaintiff explained that he lived at the shelter and Stewart stated he had not signed in, a Defendant Officer looked at the sign in sheet that Plaintiff had signed, then spoke with Stewart and then told Plaintiff he had to leave. Thereafter, Defendant Officers Montesino, Pacheco, Terrerro, Velez, and Does 2-7, acting in concert, handcuffed Plaintiff in an excessively tight manner and brought him to the 46th precinct and conducted an intrusive search, putting their hands near Plaintiff's pubic area. Plaintiff was falsely charged with trespass and held for 4 hours.
