When he arrived though, Instead of releasing his properties to him, defendant officers arrested Plaintiff and interrogated him asking him questions about other people and\nincidents. Plaintiff duly informed defendant officers that he was at the precinct to pick up his properties as agreed and Defendant officers in response assaulted Plaintiff forcibly grabbing, punching, pushing, pulling, kicking, and shoving him. Plaintiff sustained serious injuries from the assault and was transported to the hospital where he was seen and/or treated for his injuries. They then performed a search on him which did not recover any contraband, but they still continued to detain Plaintiff. The officers also falsely stated to the prosecutors that the plaintiff committed ‘Obstructing governmental administration in the second degree’ and ‘Resisting arrest’ and then falsified police reports, which caused Plaintiff to be criminally charged. Defendants Detective Petrelli, Under Cover Office #0228, and Police Officer John Does #1 and #2 were also in the park conducting a \"buy and bust operation.\" One of the defendants approached Plaintiff Baum and demanded that the plaintiff sell them narcotics. Plaintiff denied the Defendant's request. Shortly after that, without probable cause to do so, the Defendants approached the Plaintiff and sprayed pepper spray into his eyes. The plaintiff was then tackled to the ground and one of the defendants put his knee on the plaintiff's back and put excessively tight handcuffs on him.  Plaintiff was then driven around in a police vehicle for at least one hour. When Platiniff was eventually transported to a NYPD precinct, he was subjected to an unlawful strip search. After a period of time longer than 24 hours, Plaintiff Baum was arraigned and ultimately detained at Rikers Island from September 27, 2011 to December 11, 2012. \n\nUpon admission to the Department of Corrections, Plaintiff told staff that he was prescribed Xanex and Seroquel for his mental health. Plaintiff suffered from depression, anxiety and schizophrenia.  Based on DOC policy, plaintiff was not permitted to receive Xanex. Instead plaintiff had to withdraw from Xanex via another psychotropic medication, Librium, for one week. Plaintiff repeatedly informed the staff at Rikers Island that this was not the proper way to withdraw from Xanex, but they insisted on having him do so anyway. As a result, Plaintiff suffered anxiety, depression and stress for the entire duration of his incarceration. \n\nPlaintiff was indicted and prosecuted based on the Defendants false allegations.
