They slammed him to the ground, dragged him to the police car. The Defendants attempted to forcibly shove the Plaintiff into a police car by using excessive force, causing head injuries that led to him losing consciousness. The Plaintiff subsequently woke up three days later with severe injuries, including quadriplegia. \n\nThe Plaintiff was falsely arrested, excessive force was used, assault and battery took place, and he was a victim of a malicious prosecution. The Defendants were motivated by racial prejudice and aimed to meet arrest quotas while fabricating allegations against the Plaintiff regarding drug possession and a false account of the Plaintiffs injuries. \n\nThe Plaintiff was held without without a valid judicial warrant, without probable cause and wrongfully incarcerated. On August 3 2016, the DA declined to prosecute due to a lack of evidence. Ultimately, the Defendants acted with malice, conveyed the false, misleading and incomplete information to prosecutors. \n\nOfficers John or Jane Doe 1-10 failed to intervene at any point. Defendants grabbed Plaintiff and his video camera and handcuffed and arrested the plaintiff and brought him to the PSA 7 precinct. \n\nPlaintiff, who was known for exposing police conduct through his role in CopWatch Patrol, was recognized when he was brought to the precinct and officers cheered at his arrest. Plaintiff was searched and his property removed. One Defendant classified Plaintiff's two way radio as a police scanner and relied upon the false classification to allege Plaintiff was guilty of a felony. Although Plaintiff's attorney arrived, Officers ignored the attorney and attempted to question Plaintiff without his lawyer present. Plaintiff heard and recorded officers acknowledging that Plaintiff never got within 15-20 feet of them while recording Defendants interacting with the two civilians yet determining they would still charge Plaintiff with interference. \n\nDefendants did not issue a desk appearance ticket and instead kept plaintiff in custody for approximately 24 hours. At 9pm on August 6, Plaintiff was released from custody without explanation or charges. But that same night, Defendants rearrested Plaintiff after making false statements to secure charges against Plaintiff. Plaintiff received notice that Defendants were attempting to unlock his phone despite Defendants not having a warrant.
