Defendant Western Retail Beef Inc. and several unnamed defendants approached Plaintiff when he was attempting to retrieve a grocery bag to purchase along with his groceries. Defendants battered and assaulted his person by, forcibly grabbing a grocery bag from Plaintiff’s hand, violently punching Plaintiff in his face with a closed fist, and then by grabbing Plaintiff’s walking cane and using it to bash his head and neck multiple times, causing Plaintiff to suffer substantial pain, injury to his face, head, and neck, the aggravation of his pre-existing health issues and conditions, extreme shock, and severe emotional distress.  Defendant Officers Jeetendra Bhudial, Defendant Officer Sharday Harris and several unnamed defendant officers arrived, approached Plaintiff, a victim of assault and battery, and unlawfully stopped, detained, and questioned Plaintiff without probable cause, reasonable suspicion, or any legal justification whatsoever. Plaintiff then explained to Defendant officers that he was attacked by the unnamed defendants and that he and his wife had video recording of the incident from their own personal body cameras they were wearing. The Defendant officers then ignored Plaintiff’s statements simply because there was a complaining witness, thereby ignoring the exculpatory information proffered by Plaintiff and his wife, and then proceeded to illegally seize Plaintiff’s person with their outstretched hands violently grabbing onto his person, causing Plaintiff to suffer further pain, shock, aggravation of his pre-existing health issues and conditions, and emotional distress. The Defendant officers then proceeded to conduct an illegal search of Plaintiff’s person in plain view of bystanders, without Plaintiff’s consent, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever as to the commission of unlawful conduct on the part of Plaintiff. The Defendant officers then accused Plaintiff of a criminal offense, and violently contorted his arms behind his back to affix metal handcuffs to Plaintiff’s wrists in an excessively tightened fashion. Plaintiff complained of the tight handcuffs but his complaints were ignored. The Defendant officers then placed Plaintiff in a police vehicle and transported him against his will to the 42nd Precinct, and then, while taking Plaintiff out of the police vehicle, said Defendants, then dropped Plaintiff on the ground. At the 42nd Precinct, Plaintiff was fingerprinted, searched or strip-searched, photographed, questioned as to his pedigree, unlawfully interrogated without presence of counsel, denied medical attention, and illegally detained in a dank and dirty cell for approximately six (6) hours before being transported to Central Booking. At Central Booking,  Plaintiff was again fingerprinted, searched or strip- searched, photographed, questioned as to his pedigree, denied medical attention, and illegally detained throughout various dank and dirty cells for approximately twenty (20) hours before being released from physical custody after his criminal court arraignment.
