Morales, returnable at Criminal Court. Plaintiff pointed out to Morales that their conduct was not illegal and that the summons should instead be returnable at the NYC Environmental Control Board, and Morales brought over Defendant Lieutenant Khan, who ordered Plaintiff to close down his vendor display. When Plaintiff protested that this decision had to be left to a judge, Khan ordered Morales to arrest him. Morales complied, charging Plaintiff with obstruction of governmental administration and disorderly conduct. Morales handcuffed Plaintiff excessively tightly, aggravating a preexisting medical condition to Plaintiff's hand, causing him pain and requiring him to seek medical attention. These charges were dismissed by the DA on December 5, 2016. Morales also issued Plaintiff two summonses for the ECB, which were dismissed at an ECB hearing on April 26, 2016. \n\nOn May 3, 2016, while Plaintiff was selling artworks at the same location, Defendant Sergeant Bergen physically assaulted him, threatened him, and had Defendant P.O. Tansey issue a summons for the ECB. At a hearing on June 1, 2016, the summons was dismissed, and Plaintiff informed Bergen that all summonses issued against him were being dismissed. On June 18, 2016, Defendant P.O. Williams issued Plaintiff a Criminal Court summons, which was dismissed on September 7, 2016. On February 11, 2017, Defendants Sergeant Bergen and Captain O'Hara ordered Defendant P.O. Scialabba to issue a summons to Plaintiff. Another summons was issued on July 21, 2017. Between June 1 – October 14, 2018, Plaintiff was served with a total of 21 summonses by Defendants Sgt. McGurran, P.O. Lachmenar, Sgt. Murphy, Lt. Khan, P.O. DiCandia, Sgt. Schack, P.O. Desalto, P.O. Mohandes, P.O. Espinal, Sgt. Forlenza, P.O. Rahman, & P.O. Gao. All of these summonses were dismissed. On August 14, 2018, Khan, Lachmenar, Mohandes, & Murphy seized Plaintiff's original works of art, which he was selling, left it out in the rain to damage it, and confiscated it. On January 8, 2020, Plaintiff was issued another summons by Defendant P.O.
