Plaintiff tried to explain to the defendant officers that he was leaving a birthday party when he heard a shooting and that he and the others were running to safety. The defendants had no probable cause or reasonable suspicion that the plaintiff was engaged in an illegal activity. The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants transported plaintiff to the 73rd Precinct, where he was fingerprinted, photographed, and placed in a holding cell. After approximately 24 hours at the 73rd Precinct, Plaintiff was transported to Kings County Central Bookings, where he was again processed and placed in a holding cell. While Plaintiff was in the custody of the defendants, Defendants prepared and filed false paperwork alleging that plaintiff committed murder and criminal possession of a weapon. On October 19, 2020, Plaintiff was arraigned in criminal court, charged, and remanded to Rikers Island Correctional Facility for 30 months, vehemently professing his innocence and awaiting justice to be done. Plaintiff was unlawfully detained for approximately 24 hours before he was arraigned in Kings County Criminal Court on November 28, 2019 and charged with felony crimes without probable cause based upon the defendants’ false, misleading, and incomplete allegations against plaintiff. Plaintiff was remanded into DOC custody where he was unlawfully detained for approximately 1 week before he was able to post bail and was released from custody. The defendants who did not physically touch plaintiff but observed their fellow officers violating plaintiff's rights but neglected to intervene to stop their fellow officers failed to intervene. Plaintiff was subject to the negligent inflction of emotional distress by the defendants. Plaintiff lost his employment due to the arrest. After 24 hours in custody the Plaintiff was released on his own recognizance.
