His cousin was in the driver's seat and the engine was on. Officers pulled up and told them they were stopped because the car was in front of a fire hydrant. The officers falsely claimed they smelled marijuana and then asked them all for identification. Plaintiffs cousin gave permission to search the car. When officers searched the trunk, plaintiff took issue as they could not see the search and officers could plant contraband. Plaintiff and the other men were then removed from the car, searched and placed under arrest. Plaintiff's cuffs were excessively tight and he requested they be loosened but was denied. Plaintiff was then taken to the precinct, where he was told he ewas arrested because officers had found a fraudulent card in the trunk. Plaintiff remained in excessively tight cuffs for an additional 35 minutes before htey were removed. He was taken to central booking and held for other 24 hours before he was released.
