The plaintiff was not involved in the altercation, and he and his friends decided to leave the park.\nAs Plaintiff was leaving, he was approached by four predominantly white police officers who, without provocation or explanation, began to assault him. One officer kneed the Plaintiff in the mouth, breaking his jaw. The officers then transported the Plaintiff to the precinct, where they issued a baseless disorderly conduct ticket as a cover-up for their assault on the Plaintiff.\nUpon being released from the precinct, the Plaintiff went directly to the hospital due to the intense pain from his broken jaw. He was admitted overnight at Our Lady of Mercy Hospital in the Bronx and then transferred to Montefiore Hospital the next day, where he underwent emergency surgery to repair his jaw with two metal plates.\nOn May 25, 2012, Plaintiff appeared in court to contest the disorderly conduct summons, but the judge dismissed the charge, ruling the ticket was defective. It did not substantiate the claim of disorderly conduct.\nAt the time of the incident, Police Officer Esther and other officers acted under the direction of their superiors. Upon information and belief, Police Commissioner Raymond Kelly, who oversees the NYPD, condones and turns a blind eye to widespread illegal practices, including “stop and frisk” policies that target minority citizens, resulting in unlawful arrests and imprisonment without probable cause.\nIt is asserted that these illegal policies and procedures led to the unlawful stop and assault of the Plaintiff, who was not involved in any criminal activity but was in the vicinity of the fight. The officers’ actions violated the Plaintiff's constitutional rights, including excessive force, false arrest, malicious prosecution, and racial discrimination, among other wrongs.
