In fact, on July 8th 2020, Plaintiff was involved in a traffic accident at the intersection between New York Avenue and Fulton Street. Two NYPD vehicles were parked at the Mercy Avenue entrance of Fulton Street because of public demonstrations occurring in or about that area. After the struck, the operator of the other vehicle, a light skin male, went to talk with the defendants standing by their vehicles , three male and one female. Upon speaking with the police officers, the operator of the other vehicle together with two police officers, both male, one white and the other possibly Hispanic, began walking back to where Plaintiff was parked. At this point the Plaintiff exited his vehicle and began to approach the police officers walking in his direction. When Plaintiff reached the Police officers, the white Police Officer stated to Plaintiff that NYPD were not filling out accident reports on the scene because of COVID-19 and that Plaintiff had to prepare it himself and mail it out to the Department of Motor Vehicles.\n Upon receiving this instruction, Plaintiff reentered his vehicle and left the scene. A few time later, he returned to the scene on foot,  reached the police vehicles and began video-taping the police officers with his phone asking them why they refused to fill out a police report on the accident and or take information from the driver or the other vehicles. The Defendants confirmed what they had already stated before, and Plaintiff  left the scene again. Several weeks later, Plaintiff was surprised to learn from a TV news report that on July 8th 2020 he would have been involved in a robbery using a bat and that the police were looking for him. He went to 79th precinct to exonerate himself, but there he was booked and arrested.
