Approximately four (4) months before said date and time, Plaintiff was caused to suffer a gunshot wound to his leg and was recovering with treatment from this injury on said date and time of this complained-of-incident. On said date and time, Plaintiff was lawfully present, sitting in his wheelchair, and had committed no criminal offense, in the vicinity of this complained-of-incident.  On said date and time, Defendants then appeared in the vicinity of this complained-of-incident then approached Plaintiff and illegally stopped and detained him. Defendants then falsely accused Plaintiff of a criminal offense and demanded that he stand up with his injured leg. Plaintiff then explained to Defendants that he had an injured leg and could not walk but said defendants outright refused to listen to Plaintiff’s complaints and then illegally seized his person with their outstretched hands aggressively grabbing him about his head and body, violently lifting Plaintiff from his wheelchair without his consent, before unlawfully searching his person by rifling their hands in and out of Plaintiff’s clothing and personal belongings. Defendants recovered no contraband from Plaintiff’s person or belongs to indicate that he committed any crime. Defendants then grabbed Plaintiff about his body and extremities before violently contorting his arms and wrists behind his back and applying excessively tightened metal handcuffs, causing plaintiff to experience significant pain and discomfort. Plaintiff requested that the handcuffs be loosened, but said defendants ignored plaintiff’s pleas. Defendants, including then placed Plaintiff in a police vehicle and transported him against his will to the 52nd NYPD Precinct where Plaintiff was fingerprinted, photographed, searched or strip-searched, questioned as to his pedigree, illegally interrogated without presence of counsel and being Mirandized, and illegally detained in a dank and dirty cell for a length of time before being transported to Central Booking, where Plaintiff was again processed pursuant to criminal incarceration and illegally detained throughout various dank and dirty cells over the course of a length of time until Plaintiff was released from physical custody on or about August 22 2020 after his arraignment when posting bail.\nAs a result, Plaintiff was deprived of his liberty over the course of approximately three (3) days.
