Plaintiff approached the officers and verbally engaged them about their failure to wear masks on the subway platform for about 1 to 2 minutes. In response to Plaintiff's repeated requests towards the officers to put masks on, Officer Vincent responded by alternating between sarcastically pretending he could not hear Plaintiff through Plaintiff's mask and ignoring Plaintiff. After the verbal back and forth, Officer Vincent physically seized Plaintiff by grabbing his clothes, and forced him to the exit of the station, telling him he was \"being disruptive.\" Officer Rosero-Tapo assisted Vincent by walking along with Officer Vincent and holding the emergency exit door open for Vincent to eject Plaintiff from the subway station. The officers refused to provide their names and badge numbers when Plaintiff inquired. A bystander recorded part of the interaction and posted the video online. The video went viral and then-NYPD Commissioner Shea asked the officers involved be disciplined. Between the Lorimer Street and Bedford Avenue stations, plaintiff observed a man urinating between the subway cars. Upon entering the Bedford Avenue Station, plaintiff alerted two defendant-NYPD officers, including \nOfficer Joseph Vincent (Shield No. 23708), both of whom were on the platform. The defendant-officers apprehended the man found urinating between the cars. However, during the apprehension, a separate man confronted the defendant-officers and plaintiff. This man directly threatened the plaintiff with physical violence. The defendant-officers intervened and removed the man from the train. \n\nShortly after the L train continued onward, the threatening man reappeared in the plaintiff's train car. The man's presence was due to the defendant-officers' failure to adhere to their special duty to provide protection to NYTA employees. The man immediately charged, tackled, and repeatedly punched, kicked, and chocked the plaintiff in front of passengers on the L train. During the attack, the assailant threatened to \"kill\" the plaintiff. The assailant's actions were recorded by passengers. In total, the plaintiff was attacked for a period four to five minutes. Subsequently, the conductor of the train (K. Henry - I.D. No. 385057) contacted the MTA Rail Control and plaintiff spoke with Police Officer Scarlos and Detective Mortimer of the Night Watch Unit. Thereafter, the plaintiff was taken by ambulance to Lennox Hill Greenwich Hospital. Plaintiff was unable to work from April 13, 2017 until July 26, 2017 due to the injuries suffered.
