Other officers, James rodriguez, Juan rodriguez, steven Oquendo, Jason Fernandez, Oswaldo Maldonado, David Montanez and Officers John doe 1-6 came to the premises and some officers grabbed Plaintiff, threw him to the grown and handcuffed his hands behind his back.Plaintiff was kicked in the arms and legs, and was hit with a police baton on his legs, arm and head and sprayed in the face with pepper spray and assaulted. Plaintiff blacked out during the assault. Plaintiff was then put in a police vehicle and taken to the 40th Precinct.  At the precinct Plaintiff was taken from the vehicle, slammed into the doors of the building and thrown onto the floor of a bathroom. Plaintiff told defendants that he couldn't breathe and couldn't see because of the pepper spray and asked for help and water. Defendants told Plaintiff that he oculd remain where he was and to let that burn on you for a few minutes. Plaintiff was left on the floor in pain and then was directed to a sink to wash his face off. Plaintiff was then put in a holding cell where he blacekd out again. Plaintiff was charged with various violations but the People of the State of NY refused to prosecute Plaintiff for the charges. At 10:45 am on August 19,2014, Plaitniff was released from custody and then went to Lincoln Hospital for treatment for his injuries.
