Mr. Graves rose to his knees holding a firearm, observed by Santos. Santos ordered Mr. Graves to \"put it down and stop moving and let me see your hands.\" Mr. Graves then stood up, still holding a gun in his hand. By this time, the other NYPD Defendants were on the scene, most taking cover behind nearby cars. All of the officers were shouting at Mr. Graves to alternatively \"drop the gun... put your hands behind your back... show us your hands... stop moving...\" etc. Mr. Graves did not move, but he also did not drop his gun. The NYPD Defendants then fired a total of sixty-one (61) shots at Mr. Graves, with eleven (10) hitting him. Mr. Graves died of his wounds. The gun in Mr. Grave's possession was not loaded.
