Both Defendant Officers requested identification from Plaintiff and Plaintiff provided valid identification. Plaintiff was handcuffed and arrested. Plaintiff and his daughter were both placed inside of a police car when Plaintiff was not engaged in any unlawful or illegal behavior, nor had any warrants for his arrests. Plaintiff was transported to 44 police precinct and was placed into a cell. After being held in cells for several hours in the 44 precinct, Plaintiff was released with a summons and charged with Disorderly Conduct. On September 22, 2024, the summons was dismissed by Bronx Criminal Court. As a result of the actions of Defendant Officers, Plaintiff was traumatized and fears for his physical safety when she sees and encounters members of the NYC Police Department from that day and onward.
