His brother Daniel Otero was also present.  They witnessed a dispute outside the store in which one person was shot.  Plaintiffs sheltered the injured man in their store and called 911.  After officers arrived, they questioned both Plaintiffs intensely because although they were not suspects they provided vague descriptions of the shooter.  Unsatisfied, officers grabbed Plaintiff Carlos Otero and pushed him against a wall.  When Plaintiff Daniel Otero objected, officers threw him to the ground and began kicking and striking him.  Both Plaintiffs were arrested and taken to a precinct, where they remained in handcuffs and questioned for six hours.  After several hours of requests, Plaintiff Daniel Otero was taken to a hospital for treatment of his injuries.  After being returned and held for more than 30 hours, Plaintiff Daniel Otero was released.  On April 25, 2012, NYPD officers returned to the store where Plaintiff Carlos Otero was working.  They questioned him about the shooting, and dissatisfied with the answers, again illegally searched him, put him under arrest and took him to the precinct.  Plaintiff Carlos Otero was again ticketed for disorderly conduct.  The tickets against Plaintiff Carlos Otero were dismissed on July 6, 2012 and September 11, 2012.
