After releasing her, they informed her that she was not allowed to return to her apartment until further notice, despite lacking a court order to enforce this. During the time that Plaintiff was forced out of her apartment, Defendants conducted searches within the apartment without Plaintiff’s knowledge, consent, a warrant, or legal cause. \n\nFour days later, on May 16, 2017, Plaintiff returned to her apartment to see if she can move back in. Upon her arrival, six officers, including Gonzalez and Kehoe, approached her, demanding to know who had unlocked her apartment. Plaintiff stated that she had not unlocked her apartment and did not know who had. Despite this, the officers proceeded to arrest and tightly handcuff her, even though they lacked legal cause to do so. Defendants then initiated criminal proceedings against Plaintiff using false and misleading police reports, falsely claiming that Plaintiff was in possession of marijuana. As a result, she was charged with criminal possession of marijuana in the 2nd degree. However, Plaintiff was never in possession of, nor had custody or control over, any marijuana, and no evidence of such was found on her. \n\nAfter several court appearances, all charges against Plaintiff were dismissed.
