Defendant Officers were already in that area investigating a larceny. Suddenly and without provocation, Defendant officers rushed upon Plaintiff, grabbing him and forcibly detaining him. Defendants did not observe Plaintiff committing any crime or violating any law or local ordinance. Plaintiff was subjected to an identification procedure. Defendants were told that Plaintiff was not the suspect but continued to place Plaintiff in handcuffs. Even though Defendants were aware Plaintiff was identified as the non-perpetrator and had one or more individuals who could vouch for his whereabouts, Defendants continued with Plaintiff’s arrest. Plaintiff was searched and no contraband or anything illegal was found. Plaintiff was transported to the precinct where he was subjected to an intrusive search of his body. After finding nothing, plaintiff was transported to Central Booking. Plaintiff was charged with Robbery in the Third Degree.
