Santulli chained a wheelbarrow over the neighbor's aforementioned fence when the chain broke. Plaintiff M. Santulli received a call from Defendant Officer that he would have to come to the 66th Precinct and told the Plaintiff that he had damaged his neighbors' property and had thereby committed a felony. The next day (2/7/2016) the Plaintiff returned to the 66th Precinct and Defendant Officer played a video of the events of 2/6/2016 and then asked Plaintiff M. Santulli to remove his belt and shoelaces, implying that he was under arrest. On 10/11/2016 Defendant Officer arrested Plaintiff M, Santulii for crime of criminal mischief in the 4th degree and later charges were dismissed. On 10/15/2016, Detective Roman responded to a complaint from the neighbors of Plaintiff G. Santulli and saw that no damages were done and left the premises (60th Street). Defendant Officer arrived at approximately 1:00pm and inspected the premise of Plaintiff G. Santulli. On 10/20/2016, Defendant Officer arrested Plaintiff G.
