Sergeant Mourad Mourad and Officer Jovaniel Cordova of the NYPD pulled up in an unmarked vehicle. After one of the officers loudly asked Kimani where his brother was, the officer then said \"You're not going to be nothing when you grow up. You're going to be just like your brother.\" Kimani then turned his back to the officers, and in an attempt to leave, tried to hop over a gate to a driveway. Defendants Mourad and Cordova stopped and seized Kimani by pointing their firearms. After Kimani got down on his knees and raised his hands straight up int he air, the named defendants shot Kimani several times. Rather than administer medical aid, defendant Hoder handcuffed Kimani behind his back and to a fence.
